Terms & Conditions

Introduction

These are the terms and conditions of the Dylan Harvey Group Limited and its subsidiaries (hereinafter referred to as Dylan Harvey) and apply to all dealings with Dylan Harvey by this vehicle or otherwise.

Any and all enquiries to buy, lease, sell or rent any land or property for and on behalf of Dylan Harvey in response to, but which shall not be limited to, all advertising and marketing placed by Dylan Harvey encompassing all adverts, leaflets pamphlets, brochures, circulars, including electronic mailings, facsimiles and website promotions hereinafter referred to as the (Information) are subject to the terms and conditions as set out herein:

Notice to Prospective Purchasers

Dylan Harvey hereby give notice that you should at your own expense seek your own independent legal and accountancy advice together with any other professional advice that may be deemed appropriate before entering into any formal business arrangements with Dylan Harvey and/or with any introduced or other third party.  Dylan Harvey also advises you that your land or property may be at risk if you do not keep up the required payments to lenders on any loans or mortgages which may have been secured against such land or property.

Deemed Acceptance

By proceeding to enter into any contractual relationship with Dylan Harvey you will be deemed to have read and accepted these terms and conditions. These terms may be varied by Dylan Harvey from time to time at their sole discretion and the revised terms will be deemed to apply to any contract with Dylan Harvey dated after the date of the revised terms. Any unauthorised use of the Information may give rise to a claim for damages.

Dylan Harvey reserves the right to alter or delete material from the Information at any time and may, at any time, revise these terms without notice.

Non-refundable deposits and reservation fees

Should you wish to proceed to purchase or take a lease of any property we are selling or marketing you will be asked for an initial holding deposit of £2,000.00, which may also be referred to as a reservation fee. By paying this deposit you acknowledge that it is non-refundable and will be kept by us if you choose not to or are otherwise unable to proceed within the time scale stipulated by us. You also acknowledge that you shall not be entitled to a refund of the deposit if (by way of example only and without limitation) there are any changes in build times as provided in the Information or otherwise. We reserve the right to ask you for a further payment prior to exchange of contacts, which will be equivalent to 5% of the purchase price less the initial holding deposit in respect of residential properties and 10% in respect of commercial properties. By paying this further payment you acknowledge that it also is non-refundable and will be kept by us if you choose not to or are otherwise unable to proceed within the time scale stipulated by us.

If any term or provision in this agreement shall be held to be illegal or unenforceable, in whole or part, under any enactment or rule of law, such term or provision or part shall to that extent be deemed not to form part of this agreement but the validity and enforceability of the remainder of this agreement shall not be affected.
